These Terms & Conditions (“Terms”) govern your use of the website https://edukinetics.com/ (the “website”) and your and your child's enrolment in, and participation in, any programme, class, assessment, or service offered by Edukinetics Practise (Pty) Ltd, trading as Edukinetics (“Edukinetics”, “we”, “us”). By using our website, submitting an enrolment or contact form, or enrolling your child in a programme, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
Where these Terms refer to “you”, this means the parent, legal guardian, or other adult with parental responsibility who enrols a child, unless the context requires otherwise (for example, where a school enrols a group of learners).
1. Our services
Edukinetics is a Kinderkinetics practice offering paediatric movement, motor-development and therapeutic programmes for children aged approximately 0 to 13 years, delivered at our practice in Brackenfell and onsite at partner schools and preschools in the surrounding areas. Our programmes are designed and delivered by Kinderkineticists registered with the South African Professional Institute for Kinderkinetics (SAPIK).
Our services support your child's motor, physical and developmental progress. They are not a substitute for medical diagnosis or treatment, and where we identify a concern that may require further assessment, we may recommend referral to another appropriately qualified professional.
2. Website use licence
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use our website for your own personal, non-commercial use. You may not:
- Modify, copy, or republish any content from our website;
- Use any content from our website for a commercial purpose or public display;
- Attempt to decompile, reverse engineer, or otherwise interfere with our website or its underlying software;
- Remove any copyright, trademark, or other proprietary notice from our content; or
- Frame, mirror, or otherwise incorporate any part of our website into another site without our written permission.
This licence terminates automatically if you breach any of these restrictions, and may be terminated by us at any time.
3. Intellectual property
All content on our website, including text, graphics, logos, photographs, videos, and the Edukinetics name and branding, is owned by or licensed to Edukinetics and is protected by South African and international copyright and trademark law, unless otherwise indicated.
4. Enrolment, fees and payment
- Enrolment in a programme is confirmed once you submit a completed enrolment form and we accept it, subject to availability.
- Fees for our programmes are set out on our website or communicated to you directly, and are payable by direct bank transfer (EFT) to the account details we provide. We do not process card payments through this website.
- Invoices are issued automatically on the first day of each month, from February to December, and cover that month's lessons in advance. Payment is due by the 7th of that month.
- We reserve the right to suspend a child's place in a programme if fees fall into arrears, after reasonable notice to you.
- We may review and adjust our fees from time to time, with reasonable notice before any change takes effect for existing clients.
From January 2027, this billing cycle is changing: invoices will be issued on the 25th of the preceding month, and will be due by the first of the month to which they relate. This page will be updated closer to the time, and clients will be notified in advance.
Full detail on cancellations, notice periods, and refunds is set out in our separate Refund & Cancellation Policy, which forms part of these Terms.
5. Health, safety and parental responsibility
- You are responsible for disclosing to us, honestly and completely, any medical condition, injury, allergy, or other health-related information relevant to your child's safe participation in our programmes.
- You confirm that your child is medically fit to participate in movement-based activities, unless you have told us otherwise, in which case we will work with you to adapt the programme appropriately or, where necessary, decline to provide the service.
- You agree to keep your contact details up to date so that we can reach you promptly in the event of an incident involving your child.
- Our staff will take reasonable care for your child's safety and wellbeing during sessions, consistent with the standards expected of registered Kinderkineticists, but physical activity carries an inherent risk of minor injury (such as bumps, falls, or strains) which cannot be entirely eliminated.
6. Liability
To the maximum extent permitted by law, Edukinetics, its directors, employees, and contracted Kinderkineticists will not be liable for any indirect, incidental, or consequential loss or damage arising from your or your child's use of our services or website. Nothing in these Terms limits any liability that cannot lawfully be limited or excluded under the Consumer Protection Act 68 of 2008, including liability for gross negligence, or for death or personal injury caused by our negligence.
The materials on our website are provided “as is”. We do not warrant that the website will be uninterrupted or error-free, or that the materials are complete, accurate, or current, and we may update or correct them at any time without notice.
7. Photographs, video and testimonials
During sessions, we may take photographs or video of your child to share their progress with you and, only with your separate, explicit consent, for use in our marketing (including our website gallery, social media, and testimonials). How we handle this is set out fully in our Children's Privacy & Media Consent Policy, and your consent choices there apply regardless of anything else in these Terms.
8. Privacy
Our collection and use of personal information, including your child's information, is governed by our Privacy Policy, Cookie Consent & Policy, and Children's Privacy & Media Consent Policy, each incorporated into these Terms by reference.
9. Termination
You may withdraw your child from a programme at any time by giving us notice in accordance with our Refund & Cancellation Policy. We may suspend or end a child's participation, with reasonable notice where practicable, if fees are not paid, if these Terms are breached, or if we reasonably believe continued participation is not appropriate for the child's or other children's safety or wellbeing.
10. External links
Our website may link to third-party websites that we do not operate or control. We are not responsible for the content, accuracy, or privacy practices of any linked site, and including a link does not imply our endorsement of it.
11. Changes to these Terms
We may revise these Terms at any time by updating this page. Continued use of our website or services after a change takes effect means you accept the updated Terms. Where a change materially affects an existing enrolment (for example, a fee increase), we will give you reasonable advance notice.
12. Governing law
These Terms are governed by the laws of the Republic of South Africa, and you agree to submit to the exclusive jurisdiction of the South African courts in respect of any dispute arising from them.
