Privacy Policy

Last updated: 12 September 2026. Effective from the date of publication on this website.

Edukinetics Practise (Pty) Ltd, trading as Edukinetics (“Edukinetics”, “we”, “us” or “our”), is committed to protecting the privacy and personal information of our clients, their children, their families, our website visitors, and our staff. This Privacy Policy explains what personal information we collect, why we collect it, how we use, share, store and protect it, and what rights you and your child have over it.

We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”) and, where relevant to visitors and clients located outside South Africa, the EU/UK General Data Protection Regulation (“GDPR”) and other applicable data protection laws. Where this policy refers to “you” in relation to a child under Edukinetics's care, it is addressed to the parent, legal guardian, or other person with parental responsibility who provided that information on the child's behalf.

This policy should be read together with our Cookie Consent & Policy, Terms & Conditions, Children's Privacy & Media Consent Policy, and Marketing & Email Communications Policy, all available on this website.

2. Personal information we collect

The personal information we collect depends on how you interact with us: as a website visitor, a prospective client completing an enrolment or contact form, or a parent/guardian of a child already enrolled in one of our programmes. We collect:

2.1 Information about you (the parent, guardian, or website visitor)

  • Full name, email address, mobile/telephone number, and postal or physical address;
  • Your relationship to the child (parent, guardian, or other legally responsible person);
  • School or suburb, where relevant to arranging onsite sessions;
  • Payment and billing information necessary to invoice you for our services (we do not process card payments through this website: fees are settled by direct bank transfer/EFT, so we do not collect or store card numbers);
  • Correspondence you send us, including messages submitted through our contact, enrolment, or data request forms;
  • Technical data collected automatically when you visit our website (see section 7 and our Cookie Consent & Policy), including IP address, browser and device type, pages visited, and time and date of visit.

2.2 Information about your child

Because our services are provided directly to children, we necessarily collect and process personal information, and in some cases special personal information, about your child. This is collected from you (the parent/guardian) and, where relevant, from your child's school or referring healthcare professional, and includes:

  • Your child's full name, date of birth, gender, and the school or preschool they attend;
  • Health-related information, including any medical conditions, injuries, developmental delays, disabilities, or physical/cognitive concerns relevant to designing a safe and appropriate movement programme;
  • Developmental assessments, evaluation results, session notes, and progress reports prepared by our Kinderkineticists;
  • Photographs and video footage taken during sessions, used to share your child's progress with you and, only with your separate consent, for marketing purposes (see our Children's Privacy & Media Consent Policy);
  • Any information you or your child's school provide in a school survey, referral, or enrolment form.

Health information and information about a child under the age of 18 are both treated as “special personal information” under POPIA, and are subject to additional protection. See sections 3 and 9 below.

3. Why we process this information (our legal basis)

POPIA requires that we process personal information lawfully and only where a recognised justification applies. We rely on one or more of the following grounds, depending on the purpose:

  • Consent, for example, your consent to our using your child's photograph in marketing material, or to receiving marketing communications from us;
  • Performance of a contract: processing necessary to enrol your child, deliver sessions, and invoice you for our services;
  • Legitimate interest, for example, keeping accurate session records to monitor your child's progress and the quality of our service, provided this does not override your or your child's privacy interests;
  • Compliance with a legal obligation, for example, retaining financial records for tax purposes, or disclosing information where required by law or a competent authority;
  • Protection of a legitimate interest of the data subject, for example, sharing relevant medical information with a referring professional where necessary to protect your child's health or safety.

Because health information and children's information are special categories under POPIA, we only process them with your explicit, informed consent (given when you enrol your child and complete our intake and consent forms), or where another ground recognised under sections 26 to 35 of POPIA applies, such as where the processing is necessary to protect your child's vital interests.

4. How we use your and your child's information

  • To assess, plan, and deliver Kinderkinetics programmes and therapeutic services appropriate to your child's age, needs, and any medical conditions;
  • To communicate with you about bookings, sessions, your child's progress, and administrative matters (invoices, term dates, changes to programmes);
  • To maintain accurate records of the services provided, for continuity of care and quality monitoring;
  • To process payments and maintain financial and accounting records;
  • To send you marketing communications and share your child's photographs, videos, or testimonials, but only where you have given separate, opt-in consent (see our Marketing & Email Communications Policy and Children's Privacy & Media Consent Policy);
  • To respond to enquiries, complaints, and data subject requests;
  • To comply with our legal, regulatory, and professional obligations, including those owed to the South African Professional Institute for Kinderkinetics (SAPIK) and applicable health-record-keeping standards;
  • To improve our website and services, including through analytics described in our Cookie Consent & Policy.

We do not use your or your child's personal information for any purpose that is incompatible with the purpose for which it was originally collected, and we do not sell personal information to third parties.

5. Who we share information with

We only share personal information where necessary, and we require anyone processing personal information on our behalf (an “operator” under POPIA) to protect it to a standard at least equivalent to this policy. We may share information with:

  • Our Kinderkineticists and staff, all of whom are registered with SAPIK and have signed confidentiality agreements;
  • Your child's school, only with your consent or where necessary to coordinate an onsite session;
  • Referring or treating healthcare professionals, where you have consented to a referral or where necessary to protect your child's health;
  • IT, hosting, website, email, and administrative service providers who support our practice (acting strictly on our instructions);
  • Our accountant/bookkeeper and bank, for invoicing and payment processing;
  • Professional advisors, regulators, courts, or law enforcement, where required or permitted by law;
  • A prospective buyer or successor of our practice, in the event of a sale, merger, or restructuring of our business, subject to that party being bound by equivalent confidentiality and privacy obligations.

We do not disclose your or your child's personal information to any other third party without your permission, except where the law requires or permits it (for example, in a life-or-death situation, or where required to report a notifiable medical condition).

6. Cross-border storage and transfers

We are based in South Africa, and personal information is primarily stored and processed here. Some of the service providers we use for website hosting, email, or data backup may store or process information on servers located outside South Africa. Where this occurs, we take reasonable steps to ensure the receiving party is subject to a law, contract, or binding corporate rules that provide an adequate level of protection substantially similar to POPIA, or that you have consented to the transfer, in line with section 72 of POPIA.

7. Cookies and website analytics

Our website uses cookies and similar technologies to operate correctly, understand how visitors use our site, and (where you consent) support marketing. Full detail on the cookies we use, their purpose, and how to control them is set out in our separate Cookie Consent & Policy, which forms part of this Privacy Policy.

8. How long we keep information

We keep personal information only for as long as necessary for the purposes described in this policy, including to:

  • Provide ongoing services to your child for as long as they are enrolled with us;
  • Meet our record-keeping obligations as health and allied-health practitioners, which for children's assessment and treatment records may reasonably extend beyond your child reaching the age of majority;
  • Meet our accounting, tax, and other statutory retention obligations; and
  • Resolve any dispute or exercise or defend a legal claim.

Once information is no longer needed for these purposes, we securely delete, destroy, or de-identify it. If you withdraw consent to marketing use of a photograph or testimonial, we will remove it from future use and from our public-facing marketing materials within a reasonable time, though we may retain a record that consent was withdrawn.

9. Children's information and age restriction

Our services are for children, and we necessarily process children's personal information with the involvement and consent of a parent or legal guardian, as required by section 34 and 35 of POPIA. Our website itself, and any form on it, is intended to be used by adults (parents, guardians, or school staff) on behalf of a child, and is not directed at, or intended for completion by, children browsing unsupervised. If you believe a child has submitted personal information to us directly without appropriate parental or guardian consent, please contact us at hello@edukinetics.com so we can address it.

Full detail on how we handle photographs, video, and testimonials involving children, and how to give, withhold, or withdraw consent, is set out in our Children's Privacy & Media Consent Policy.

10. Your rights

Subject to POPIA and, where applicable, other data protection laws, you (and, on your child's behalf, you as their parent or guardian) have the right to:

  • Be informed of what personal information we hold and why (as set out in this policy);
  • Request access to the personal information we hold about you or your child;
  • Request that we correct or update inaccurate, incomplete, or outdated information;
  • Request that we delete or de-identify personal information we hold, subject to our legal and record-keeping obligations;
  • Object to our processing of personal information, including for direct marketing, at any time and free of charge;
  • Withdraw consent previously given, at any time, without affecting the lawfulness of processing carried out before withdrawal;
  • Request that we not subject you or your child to a decision based solely on automated processing (we do not currently make any such decisions);
  • Lodge a complaint with the Information Regulator of South Africa, or, where applicable, another supervisory authority, if you believe we have not complied with applicable data protection law.

You can exercise these rights, or ask us any question about this policy, by contacting us at hello@edukinetics.com or 082 307 1386. You can also use our online Personal Data Request tool, or submit a formal request under the Promotion of Access to Information Act 2 of 2000 (“PAIA”) using our PAIA Access-to-Information Request Form. See our PAIA Manual for details of that process.

If you are not satisfied with our response, you may lodge a complaint with the Information Regulator of South Africa:

  • Website: inforegulator.org.za
  • Email: enquiries@inforegulator.org.za
  • Telephone: 010 023 5200 or toll-free 0800 017 160

11. Security

We maintain reasonable technical and organisational measures to protect personal information against loss, unauthorised access, disclosure, alteration, or destruction, including restricting access to client records to staff who need it, requiring confidentiality undertakings from all practitioners, and using reputable, security-conscious service providers for our website, email, and data storage. No method of electronic storage or transmission is completely secure, and while we work hard to protect your information, we cannot guarantee its absolute security.

12. Changes to this policy

We may update this Privacy Policy from time to time to reflect changes in our practices or in the law. We will post the updated policy on this page with a new “last updated” date. If we make a material change (for example, a new purpose for processing your child's health information), we will take reasonable steps to notify you directly and, where required, seek your renewed consent.
