Edukinetics Practise (Pty) Ltd, trading as Edukinetics (“we”, “us”), works exclusively with children, from birth to around 13 years of age. This policy explains, specifically, how we protect children's personal information, and how and when we ask for parental or legal guardian consent before using a child's photograph, video, name, or testimonial for marketing purposes. It should be read together with our Privacy Policy and Marketing & Email Communications Policy.
1. Age restriction on our website
Our website, and every form on it (enrolment, contact, testimonials, and data requests), is intended to be used by adults (parents, legal guardians, or school staff) acting on behalf of a child. It is not directed at children browsing without adult supervision, and children should not submit personal information through our website themselves. If we become aware that a child has provided us with personal information directly and without the involvement of a parent or guardian, we will take reasonable steps to delete it, unless we are required to retain it by law.
2. The legal basis for processing children's information
Section 34 of the Protection of Personal Information Act 4 of 2013 (“POPIA”) generally prohibits processing the personal information of a child, unless an exception in section 35 applies. We rely on the following exceptions:
- Processing is carried out with the prior consent of a competent person, that is, you, as your child's parent or legal guardian (section 35(1)(a));
- Processing is necessary to carry out our contractual obligations to provide your child with Kinderkinetics services (section 35(1)(b)); and
- In relation to health information (a further “special personal information” category under section 26), processing is necessary to protect your child's vital interests, or is carried out with your consent as their parent or guardian (section 32).
Where we are located in, or a parent/guardian resides in, a jurisdiction covered by the EU/UK General Data Protection Regulation (“GDPR”), we note that Article 8 of the GDPR similarly requires parental consent for processing a child's data in connection with services offered directly to a child, and our practice of obtaining parental/guardian consent is consistent with that requirement.
3. Personal information we collect about your child
As explained more fully in our Privacy Policy, this includes your child's name, date of birth, gender, school, medical/health information relevant to their safe participation, developmental assessments and session notes, and photographs or video taken during sessions.
4. Photographs, video and testimonials: how we use them
We distinguish between two different uses of a photograph or video of your child, because they require different levels of consent:
4.1 Progress updates shared privately with you
We routinely take photographs and short videos during sessions to show you, privately, how your child is progressing (for example, in a weekly update or quarterly report sent to you directly). This is part of the service we provide and is necessary to perform our contract with you; you do not need to give separate marketing consent for this, though you may ask us to stop at any time.
4.2 Public marketing use
We will only use a photograph, video, name, testimonial, or any other content that identifies your child publicly, including on our website (for example, our Gallery or Testimonials pages), social media, brochures, or other promotional material, where you, as the parent or legal guardian, have given your explicit, opt-in, written consent, separate from and in addition to your general acceptance of our Terms & Conditions or Privacy Policy.
5. How we obtain your consent
We ask for media consent as part of your child's enrolment, using a clear, standalone consent question that is not pre-ticked, and that lets you choose separately whether we may:
- Use your child's photograph or video on our website (including the Gallery);
- Use your child's photograph, video, or a testimonial that names or identifies your child, on our social media pages;
- Use your child's first name (without a photograph) alongside a testimonial or review; and
- Use anonymised or non-identifying imagery (for example, a photo where your child cannot reasonably be identified) for general marketing.
Where a testimonial or review is submitted by you directly (for example, through a review platform), we treat your submission, together with any acceptance of our review-collection terms, as your consent to publish it in the form submitted, and we will remove or amend it on request.
6. Withdrawing consent
You may withdraw your consent to any public marketing use of your child's image, name, or testimonial at any time, free of charge, by contacting us at hello@edukinetics.com or 082 307 1386. Once we receive your request, we will remove the relevant content from our website and any social media pages under our control within a reasonable time (typically within 14 days), though we may not be able to remove content that has already been shared, downloaded, or cached by others outside our control, and we may retain an internal record that consent was withdrawn.
Withdrawing marketing consent does not affect your child's enrolment or the delivery of our services, and does not affect the private progress updates described in section 4.1.
7. Who can give or withdraw consent
Only a parent or legal guardian, or another adult with parental responsibility for the child, may give or withdraw consent under this policy. If more than one parent or guardian has responsibility for a child, we will act on the instruction of whichever parent or guardian completed the original enrolment or consent form, unless we are notified in writing of a dispute or a change, in which case we will pause public use of that child's image until the matter is resolved.
8. Safeguarding
We take the safety and dignity of the children in our care seriously. Our staff do not publish a child's identifying details (such as full name, home address, or school) alongside a public photograph without your consent, and we avoid publishing information that could make it possible for a stranger to identify where or when to find a specific child. 9. International visitors
If you are visiting our website or considering our services from outside South Africa, please note that our default legal framework for children's information is South African law (POPIA). Where GDPR, the UK GDPR, or another law with specific rules on children's data and consent applies to you, we will honour the higher standard of consent and control that law requires.
10. Changes to this policy
We may update this policy from time to time. The current version will always be available on this page. If a change would require broader use of your child's information or image than you originally consented to, we will ask for your renewed consent before making that change.
